Does your spouse control the money?

You don't need to understand every account today. You need an attorney who will find them, and Illinois courts can order your spouse to contribute to your attorney's fees.

01

Disclosure is required

Both spouses must exchange financial information. In contested cases that can include subpoenas, depositions and formal requests.

02

Draining accounts can be stopped

If marital money is being moved or spent, courts can issue temporary restraining orders to preserve assets.

03

Time at home counts

Illinois weighs a career set aside for domestic duties when deciding maintenance, and courts look at child care responsibilities before expecting a stay-at-home parent to work.

Know what you're entitled to ask for

What divorce lawyers for women want you to know about Illinois divorce.

These Illinois rules protect a spouse who doesn't control the money.

Accounts in your spouse's name can still be marital

Marital property generally includes assets and debts acquired during the marriage, regardless of whose name is on the account or title.

You may be able to get your fees paid

A court can order your spouse to contribute to your attorney's fees, including interim fees while the case is pending.

Maintenance can follow a formula

Generally, when combined gross income is under $500,000 and the payor has no prior support obligation, guideline maintenance is 33⅓% of the payor's net income minus 25% of the recipient's, limited so the recipient's income plus maintenance doesn't exceed 40% of combined net income.

Misconduct doesn't decide maintenance

Illinois decides maintenance without regard to marital misconduct, looking instead at income, needs, earning capacity and the marriage's length.

Common questions

Answers, not asterisks.

Questions women ask divorce lawyers in Chicago.

Is the firm led by a female divorce attorney?
Yes. The firm was founded by, and is led by, attorney Tiffany M. Hughes.
What is a wife entitled to in an Illinois divorce?
A fair, not necessarily equal, share of marital property, including assets in your spouse's name. Depending on the finances, that can include maintenance, child support and a contribution to your attorney's fees.
My spouse controls the money. How do I find it?
We use financial discovery and documentation to challenge inaccurate reporting, and we can pursue claims when marital money has been dissipated.
Can I afford a lawyer if my spouse has the money?
A court can order your spouse to contribute to your attorney's fees, including interim fees while the case is pending.
I stayed home with our children. Will the court expect me to work?
Possibly, but not automatically. Courts evaluate whether staying home is reasonable based on child care responsibilities, and a career set aside for domestic duties is a factor in maintenance.
Will I keep my children?
Illinois has no presumption in favor of either parent. Parenting time and decision-making are decided on the children's best interests, and preparation matters.
I'm afraid of my spouse. What can I do?
An Emergency Order of Protection can be issued quickly, sometimes without advance notice to the other party, and can address contact, temporary parenting time and support. If you are in immediate danger, call 911.
